Stamp Duty & Registration Charges in Rajasthan

Rates are revised by notification, so a figure quoted on a website can be out of date within months. What does not change is how the charge is calculated — and that is what lets you check any figure you are given.

Three questions decide what you pay: what the instrument is, what the property is worth for stamp purposes, and who the parties are. Get those three right and you can check any quotation yourself.

1. The instrument decides the rate

Stamp duty is charged on the document, not on the transaction in the abstract. A sale deed, a gift deed, a relinquishment deed, a lease, a mortgage and a power of attorney each attract their own treatment under the Rajasthan Stamp Act. This is why structuring matters: a transfer between family members executed as a gift deed is usually charged very differently from the same transfer executed as a sale.

2. The valuation is the DLC rate or the consideration, whichever is higher

The District Level Committee fixes a minimum rate for land in each locality — the DLC rate. Duty is calculated on the DLC value or on the consideration recorded in the deed, whichever is greater. Recording a lower price to reduce duty does not work: the State charges on the DLC value anyway, and under Section 56(2) of the Income Tax Act the shortfall can be treated as income in the buyer's hands and taxed. A deed that understates the price also caps what you can prove you paid if the transaction is later disputed.

3. The parties can reduce the rate

Rajasthan allows a reduced rate of stamp duty where the buyer is a woman, which is a genuine and widely used concession on residential purchases. A concessional rate also applies to gift deeds in favour of specified relatives — but only where the relationship is properly evidenced in the deed and supported by documents. Claiming the concession without the supporting proof is the most common reason a gift deed gets impounded for deficient stamp.

4. Registration fee is charged separately

The registration fee under the Registration Act is a separate head from stamp duty, calculated on the same value. Budget for both. There may also be a labour cess or surcharge depending on the nature of the property and the current notification.

5. Other costs to plan for

  • TDS under Section 194-IA — where the consideration is ₹50 lakh or more, the buyer must deduct tax at source and deposit it before registration.
  • Drafting and legal fees — for preparing the deed and verifying title beforehand.
  • Mutation — carrying the transfer into the revenue and municipal records after registration.
  • Society or authority transfer charges — payable to the JDA, UIT or the society where the property is leasehold.

How to confirm the current figure

Because rates change by notification, the only reliable method is to compute the duty on the day of execution against the current DLC rate for that specific locality and the current rate for that instrument. When anyone quotes you a figure, ask which DLC rate they applied and under which head — if they cannot answer, the figure is a guess. A gift deed to a specified relative attracts a concessional rate rather than full duty, which is why family transfers are often structured as gifts. The concession depends on the relationship falling within the specified category and on that relationship being evidenced — the deed must recite it and the supporting documents must be produced. Where the proof is missing the instrument can be charged at the full rate or impounded as insufficiently stamped.

An insufficiently stamped instrument is not admissible in evidence in court, which is the practical sting — you may hold the property for years and then find you cannot prove your title in a dispute. The document can be impounded and the deficit recovered along with a penalty, which can be a multiple of the shortfall. Paying the correct duty at the outset is far cheaper than curing it later under pressure.
