A sale deed is not proof that the seller owned the property. It is only proof that a document was registered. The Sub-Registrar does not verify title — the office verifies identity, collects stamp duty and records the instrument. That distinction is where almost every Jaipur property fraud lives.
Before you pay a token amount, the chain of title needs to be walked backwards: who held the property before this seller, how it passed to them, whether the patta is genuine and current, whether the land was ever agricultural and properly converted, whether a bank holds a charge, and whether a suit is already pending. A property lawyer in Jaipur earns their fee entirely in the week before the money moves.
A credible search is not a single document. It is a reconstruction of ownership that cross-checks the registered record against the revenue record and the planning record, because a defect usually shows up in only one of the three. The registered chain shows how the property moved; the Jamabandi and mutation entries show whether the revenue department agreed; the JDA or Nagar Nigam file shows whether the land could lawfully be built on at all.

Four records have to agree with each other: the registered chain of sale deeds at the Sub-Registrar, the revenue record (Jamabandi and mutation), the planning approval (JDA, UIT or Nagar Nigam patta and layout), and the encumbrance position showing no subsisting mortgage. If any one of the four contradicts the others, stop and have it explained before paying. A 30-year title search costs a small fraction of the property value and is the only reliable way to do this.
A patta is the document by which the development authority — JDA, UIT or the Nagar Nigam — recognises your right to hold and build on the land. A sale deed records a transfer between two private parties. You can hold a perfectly valid registered sale deed for a plot that has no patta, and in that situation you cannot get a building plan sanctioned, a bank loan, or in many cases a lawful resale. For plots in unapproved colonies the answer is JDA regularisation.
Yes. Registration gives a document legal form, not legal immunity. A sale deed can be set aside by a civil court under the Specific Relief Act where it was executed by fraud, impersonation, coercion or undue influence, where the executant had no title to convey, or where it rests on a power of attorney that was forged or already revoked. The suit must be filed within the limitation period, which generally runs three years from when the fraud was discovered.
Act quickly and on two tracks. File a civil suit for possession together with an urgent application for a temporary injunction restraining the occupant from constructing, selling or parting with possession — delay lets them raise construction, which makes removal far harder. Where the entry involved forged documents or criminal trespass, a police complaint should run alongside. Bring your title deed, patta and photographs of the current state of the plot.
Check first whether the project is registered with RERA Rajasthan, because a registered project gives you a direct complaint route for refund with interest or delay compensation under the Real Estate (Regulation and Development) Act, 2016. A consumer complaint for deficiency in service is an alternative. Which forum suits you depends on what you want — exit with a refund, or possession with compensation. Keep the builder-buyer agreement, every payment receipt and all written communication.
Treat a GPA sale as a warning sign. Following the Supreme Court's decision in Suraj Lamp & Industries v. State of Haryana (2011), a general power of attorney does not transfer ownership — title passes only by a registered sale deed. A GPA holder can validly execute a sale deed on the principal's behalf if the GPA is registered, specifically empowers sale, and is still alive and unrevoked. Verify all three before proceeding, and confirm the principal is living, since a power of attorney lapses on death.
